Colorado Lemon Law Qualifications

MAJOR SAFETY DEFECT

At least two repair attempts have been done on the vehicle for a substantial safety defect that can potentially cause serious bodily injury or death.

FOUR REPAIR ATTEMPTS

At least four repair attempts have been done on the new vehicle for the same non-serious safety defect or issue.

30 DAYS IN THE SHOP

The vehicle is in the repair shop and can’t be used for a total of more than 30 days (cumulative) for any combination of defects.

What is the Colorado Lemon Law?

The Colorado Lemon Law, codified in Title 42, Article 10, Sections 42-10-101 to 42-10-107 of the Colorado Revised Statutes, protects consumers who purchase new vehicles with substantial defects that affect the vehicle's use, value, or safety.

What types of vehicles are covered under the Colorado Lemon Law?

The law covers new motor vehicles, including cars, trucks, and vans, purchased or leased with a manufacturer’s warranty. It does not cover motorcycles, motor homes, or used vehicles.

How many repair attempts are considered reasonable under the Colorado Lemon Law?

The law considers a reasonable number of repair attempts to be either four repair attempts for the same defect or condition, or 30 business days out of service due to the defect.

What qualifies as a substantial defect under the Colorado Lemon Law?

A substantial defect is one that significantly impairs the use, value, or safety of the vehicle. Examples include engine problems, transmission issues, brake failures, electrical system malfunctions, and steering issues.

How long does the manufacturer have to repair the defect under the Colorado Lemon Law?

The manufacturer must repair the defect within the warranty period or within one year of delivery to the consumer, whichever comes first. The updated law extends this period to two years or 24,000 miles, whichever comes first.

What should I do if my vehicle qualifies as a lemon under the Colorado Lemon Law?

Notify the manufacturer in writing about the defect, providing details of the defect, previous repair attempts, and the vehicle's mileage. Keep detailed records of all repair attempts and communications with the manufacturer.

Can I still get warranty repairs during my lemon law claim?

Yes, your warranty remains valid and unaffected by the lemon law claim. You can continue to receive warranty repairs even if you file a claim.

What are the steps to file a Colorado Lemon Law claim?

First, notify the manufacturer in writing about the defect. If the defect persists after a reasonable number of repair attempts, request a final repair attempt. If the issue remains unresolved, consult with a lemon law attorney to pursue a claim.
