Our Process
Stage 1: Initial Interview
This is a free case consultation where we review the facts of your case and determine if you have a valid Lemon Law claim. We will also discuss the settlement options available to you during the case evaluation. If for any reason, we are unable to take on your case, we will inform you and advise you about other avenues you may explore with your claim.
Stage 2: Evidence Gathering & Onboarding
If we determine during the initial interview that you have a strong case, we will outline the documents you’ll need to submit to serve as evidence for your case. It is important that these documents are submitted in a timely manner to proceed with your case. These documents may include your purchase agreement, repair orders, and warranty information. At this time, you will also need to sign a retainer form to engage our services as your lemon law attorneys. In many states, Lemon Laws require manufacturers to cover attorney’s fees, meaning our services often come at no cost to you. Specifics can vary by state; our attorneys will clarify how this applies in your jurisdiction.
Stage 3: Case Filing
Once you have signed the retainer and submitted your documents, we can file your claim for compensation under the Lemon Laws in the proper court jurisdiction.
Stage 4: Negotiating with the Manufacturer
When the case is filed, the auto manufacturer/defendant will likely propose an out-of-court settlement to avoid additional litigation costs. Your attorneys will negotiate with the manufacturer to arrive at a maximum settlement that’s favorable and acceptable to you.
Stage 5: Litigation
We will do everything in our power to make sure you get the compensation that’s rightfully yours. In rare cases when an auto manufacturer doesn’t offer a fair settlement, we’ll fight and aggressively litigate your case until we win a favorable verdict! In our experience, auto manufacturers will often settle to avoid costly trials or punitive court-mandated settlements.
