My 2020 Hyundai Tucson Is A Huge Disappointment

Dear Suzanne, 

I am a frustrated owner of a 2020 Hyundai Tucson. I’ve taken my car in for repairs on three separate occasions, despite having only 4800 miles on it. That’s a visit to the Hyundai dealership every 1600 miles. This has been a lot to deal with for a vehicle I just got. 

It all began when I got it about two or three months ago. I was so excited about getting a car that I skipped checking reviews by other Hyundai Tucson owners. This is where I messed up. If I had checked, I would have had an idea of what was to come. 

I was so happy to finally have my Hyundai, but only a few weeks after buying it I noticed a problem with the engine. I took it to the dealership and they told me they couldn’t replicate the problem. So I took my car back home. 

Reached The Breaking Point

Then about four weeks ago, while driving on the highway with my kids, the car broke down. I had to call a tow truck to take my car to the dealership. When I arrived they told me that it would be a couple of weeks before they could fix it. 

But here we are, four weeks later. I still haven’t heard anything while my Hyundai continues to sit at the dealership. 

Not A Fair Deal

 During this time, the dealership offered to cover the cost of Uber rides. While I appreciate their effort, it’s nowhere near the convenience of having my own vehicle. When I asked about a rental car, the dealership informed me that none were available. Relying on third party transportation is not an acceptable substitute for the working Tucson I thought I purchased.

 I miss the freedom of driving my own car. If I had known the extent of these issues from the beginning, I would have considered other options. I now find myself unable to go to places I love due to the cost and inconvenience. And it’s incredibly difficult to take my children anywhere. Everyone in my household feels the impact of this ordeal. 

I Want Out!

I want out of this stressful situation, which is why I’m exploring lemon law. My family needs reliable transportation, and the Hyundai Tucson I own is not it. If there’s any advice or resources you could point me to I would greatly appreciate it.

While I’m glad they covered your Uber costs, it seems there’s definitely something wrong with the vehicle, and the dealership doesn’t know how to address it. 

Not So Uncommon

Doing our own research is very important for large purchases like a new car. Unfortunately, these issues are quite common with certain Hyundai models. It often starts with the engine light or a slight whining sound and eventually leads to major engine or transmission issues. Given that your car only has 4800 miles on it, you shouldn’t be having these problems no matter the brand.

In situations like yours, building a solid lemon law case is crucial. This allows you to seek the maximum compensation that you deserve. The fact that you’ve had it at the dealership several times (recently for a month!) all under the manufacturer warranty means you probably have a strong case.

Types Of Lemon Law Compensation

As a lemon owner there are a few different forms of compensation available to you. The buyback option is like a refund. The automaker takes the vehicle and refunds what you paid including the down payment, monthly payments, taxes, and interest. A mileage offset may be deducted from this amount based on what you drove before your first visit to the dealer. However, your lawyer may argue to reduce or waive this deduction.

Another option is called cash and keep, where you keep the vehicle and receive cash to offset the issues you’ve been facing. This allows your warranty to remain valid, and you can sell the car later without disclosing its lemon status. Another more rare option involves the manufacturer outright replacing your vehicle with a new one.

If you’re located in California, you have an advantage. California has some of the most consumer friendly lemon laws in the country. Lemon law cases are typically taken on a contingency basis, meaning you won’t have to pay attorney fees upfront or after. Regardless of the outcome of your case, the original settlement will go to you, while the manufacturer covers the law firm’s fees.
